Orders should be sent by email or post/courier.
We make every attempt to maintain sufficient inventory to handle all routine orders without backorders. If a backorder occurs and you prefer partial shipment or for us to hold the order until complete, please notify us.
If an order is placed by email or post/courier with a purchase order and payment details, the order is considered confirmed.
4. Returns, Refunds, Adjustments
Pearson guarantees satisfaction with the physical quality of the test materials covered by these terms and conditions. If materials are damaged, defective, or spurious on receipt, they may be returned for exchange or refund. Refunds are typically processed within 30 days.
Pearson must sometimes restrict the sale of certain test materials due to copyright restrictions, contractual arrangements, or legal requirements.
Customers must securely destroy any old or obsolete testing materials from Pearson Clinical in accordance with Pearson’s Legal Policies and Terms of Purchase.
Terms and Conditions of Sale and Use of Pearson Products
1. Acceptance of Terms and Conditions of Use
Pearson India Education Services Private Limited (“Pearson” or “us”), with registered office at Featherlite “The Address,” Chennai, and corporate offices in Bengaluru and Noida, provides products (“Products”) subject to acceptance of these Ts & Cs.
Sales of Products and the purchase and use of those Products by the Customer are conditioned upon acceptance of these Ts & Cs. Customer agrees by submitting qualifications, placing orders, or paying a Pearson invoice. These Ts & Cs constitute the entire agreement between Pearson and the Customer.
The Ts & Cs applicable at the time of the order govern the order.
Pearson warrants that Products published directly or under license will not infringe valid third-party rights existing at the time of publication. This warranty excludes products by other publishers and claims arising from combinations with third-party systems.
If notified promptly of an infringement claim, Pearson may defend the claim and provide a replacement or repurchase remaining stock.
3. Limitation of Liability and Limitation on Claims
Pearson is not liable for indirect, incidental, consequential, special, or exemplary damages. Total liability shall not exceed the amount paid by the Customer for the Products or services.
Pearson may refuse orders if it believes Products may not be properly used.
Customers agree to use Products in accordance with professional guidelines and confirm they possess the required qualifications.
Products may not be resold, relicensed, transferred, or redistributed without written permission.
5. Copyright and Trade Secrets
Pearson Products are protected by copyright, trade secrets, and trademark laws. Reproduction or unauthorised distribution is prohibited.
Pearson is not liable for non-performance caused by events beyond its reasonable control.
Customer agrees that Pearson Products obtained within India will not be exported except as authorised by applicable export laws.
Customers agree to maintain minimum test security, including:
No coaching, no reproduction, restricted access, and no resale or redistribution of materials.
All prices include GST. Payments within India must be made in INR. Payments outside India but within the Indian subcontinent must be made in USD.
All orders are shipped by traceable means. Shipping is free for all orders.
“Ts & Cs” refers to these Terms and Conditions.
“Product(s)” refers to assessment instruments and related materials.
“Customer” refers to the purchaser and qualified user.
Pearson may change Ts & Cs without notice; the version applicable at the time of order applies.
Policies
Reproduction of Pearson materials requires prior written consent.
2. Permission to Use Copyrighted Test Norms
Copying test norms is prohibited without written permission.
Qualified researchers may conduct studies using Pearson Products but may not reproduce test materials.
Purchasing eligibility is limited to qualified professionals.
Unauthorised use of Pearson trademarks is prohibited.
6. Rules Governing License of Materials
Institutions must have qualified staff to use Pearson Products appropriately.
